Because of the failing economy, getting creative with property division may be the best way to protect your assets in a divorce. However, this takes cooperation on the parts of both parties and must be very in depth in many cases.
Because of the recession, many couples’ assets are currently valued at significantly lower amounts than they were just a few years ago. Because of this, it may be a poor choice to sell those assets. Taking another approach could save both parties a great deal of money and allow both to hang on to important assets.

A few days before Christmas 2006, a woman allowed her children to see their father. A few hours after leaving them with him, she returned to find that he had set her home on fire and locked the children inside. When his daughter tried to escape, he stabbed her.
The father had a history of violence and was determined in his actions. As a result, a new law has been signed by Governor Charlie Crist to change custody battles that involve parents with histories of domestic or child abuse. This law hopes to avoid tragic incidents like the one above.

A man was sentenced to serve five years in state prison for felony child desertion. The trial ended with the man’s guilty plea in November, but the judge delayed sentencing to allow him to come up with $12,000 in back child support payments.
Because the man did not come up with the money, he is going to prison. The sentence came on Monday based on the three counts of desertion. Because he did not come up with the money, there will still be nothing to go to the children.

For many, having a prenuptial agreement is an uncomfortable idea. However, it can also be a very good one. Looking at the media, you can see messy divorces of rich and famous couples trying to get as much money as possible.
However, that does not have to be the case. With a prenuptial agreement, you set the rules of a divorce well before it is at hand. This agreement allows for a fair and agreeable settlement for both parties and can help avoid a great deal of court time in a divorce.
